Bad insurance problem!!

Postby GrahamRS on Tue May 22, 2007 7:02 pm

basically, before i was working doing deliveries in my car, so i bought business insurance with YES car insurance.. although my mum was the policy holder and i was the named driver. Among purchasing the insurace, we phones many times to make sure we had every detail right, and that i was insured for business.

all seemed fine.

i got pulled by the police the next day, and they asked to make sure i had business insurance.. so i produced my documents, hadnt heard nething for 3 months, then they send me a set of documents saying i didnt have business insurance, and i had to go to court.

so phoned up the insurance company, and they said i was insured, then they rung me back 2 days later, saying i didnt! WTF!!

and they knew i wanted the insurance, as they sent me a letter 10weeks after the date we started the policy asking us to contact them, which we didnt as i had cancelled insurance, and that was for them to tell me i wasnt convered for business!! so they knew i wanted the business insurance.. what the hell do i do??

thanks

Saddly it sounds like a scary case of 6points. Regardless of how s**t the insurance company is in the eyes of the law it's your responsability to make sure you're sufficiently insured.

I didn't think you could have business use on the policy for a named driver only the policy holder but I may be corrected on that.

do you have any documentation from the company in writing that covers any of this? or are these just phone conversations?

Also look in the terms & conditions or policy cover certificate. It has to explicitly say that you are covered I think. Like on mine it explicitly says policy holder is allowed to drive other vehicle blah blah. Doesn't say anything about named drivers. So if it doesn't explcitly say anything about your cover, then I am not sure that you are covered :(

isnt it enough that youve phoned the insurance company, theve said you ARE insured, then your insurance certificate lands on the doormat.

what more can you do, that is a nutsack situation to be in and if youve done everything you possibly can to check if your insured then what more can you do without ringing the insurance ompany every morning and asking if you are stil insured

Saddly no in the eyes of the law. As said by law it is the resposibility of the driver to ensure they have adequate cover. How rubbish the insurer has been is neither here nor there.

There was a case a few years ago on th etelly where an insurance company had gone bust and it was said then that people who had been insured with them were open to prosecution for driving with no insurance :oooh:

Which insurance company was it out of interest. Other people insured by them may want to check their policies too.
