I'm not signing. Why?
Section 59's help - if you drive sensibly and legally and have nothing wrong with your car you have nothing to worry about. I'd rather there be something that can be done about the useless tugger in 1.0l Corsa/Nova/Saxo's etc.
Typical thing about these petitions -
1. Nothing will happen
2. There is no mention of any possible alternatives in the petition.

What the point in this? Useless petition. Its never going to stop. Its like someone making one for insurance, its just a waste of time.

Section 59 Police Reform Act 2002 states that -
Where an officer has reasonable grounds for believing that a motor vehicle is being used in a manner which contravenes Road Traffic Act Section 3 (Careless Driving) OR Section 34 (Driving elsewhere than on a road) AND also the manner of use of the vehicle is causing or has been causing or is likely to cause, alarm distress or annoyance to members of the public, Section 59 can be used to:-
initially give a written warning (valid for twelve months)
(commonly called a Section 59 Notice)
and on a subsequent occasion to seize the vehicle.
(it will probably end up in the crusher, or may be ransomed back to the owner)
A constable in uniform has the power to order the person driving to stop the vehicle, to seize and remove the vehicle, to enter any premises on which the officer has reasonable grounds for believing the motor vehicle to be and to use reasonable force. Seizure can made only if a warning has been given, or believed to have been given, or if a warning is clearly being ignored.
So, usually it's a two-stage process - a warning or notice first, seizure if you persist or repeat.

yea they can give you one for pretty much anything, i got one before and it was a case of being wrong place at wrong time...
if you get a 2nd one they can take your car off you and crush it i thnk.

well yhe old bill in deal/dover/sandwich hand them out like sweeties lol i had one mate that got one cos he accidently done the tiniest wheelspin out of a notoriously slippery junction when wet and its was raining. also another for listenin to music in his car not very loud at all in a car park well in the middle of no where and other similar cases what worries me is the old bill dont need any evidence at all to issue you with a sec 59 they can issue you one with suspicion which is wrong eg if you have a big bore exhaust on your car they can issue you with one even if they aint heard the car run just cos they feel that it will at some point in the future cause alarm/distress to the public ive got a 3 inch magnex exhaust on my car and for a turbo exhaust its well quiet

also id like to say if you lot are fortinate enough to have old bill in your town that are reasonable/not bored and lookin for things to do well your very lucky and avoid the deal area at all costs lol u have been warned seroiusly the old bill here use their sec 59 powers to bully people

Two friends of mine got one each for the most pointless race down a dual carriageway ever, turbo diesel escort vs subaru...
Another got one because he was sat behind a unmarked car in town with his music turned up..
Gotta love the police, there is one good one in every ten, but while some smackhead is burgling your Grandma's home, someone down the road is being done for having a brake light out.

There are a number of things that annoy me.
One of which being people who drive through residential area's with their stereo loud enough to make my entire house vibrate.
Another being people who, at 2:00am, think it's acceptable to wheel spin down the road whilst blasting their horn at their mates.
So I agree, it is a sad country we live in, and no, I'm not signing it.

sign it till its rewritten with defined lines.
prob wont make a difference but never know. A potition I signed to stop a new law worked it was revamped and re submitted. I was shocked it was as if they had read my suggestions for amendments and followed them.

I don't sign any of those rediculous petitions, clearly just a way for number 10 to make people think they give a crap about what people want, when of course they don't.
Also, I don't drive like a tw@t and I look after my car in terms of tyres/lights etc so don't have cause to worry about being pulled

1) Why is the petition to abolish the section 59, not change the way they are handed out?
2) The Police can't always be spot on right handing these out, the act is written quite losely to say if you do anything that slightly contravines road traffic laws, you get a sec 59. That's not really stupid IMO, it's just strict, and there's a lack of that in this country.
3) Gordon Brown is in number ten and a) He's a moron, I doubt he knows what a Section 59 is........ and b) He's got much bigger fish to fry if he wants to stay in number 10 after the next election (That's fighting for the impossible IMO).
The only people who sign that petition will be the ones who have been given Section 59's before and be-grudge it, or the ones who are just a bit naive..... or simple....
Here's what will happen, half of the UK population could sign that petition, and some over paid moron will send an email to everyone who signed it saying "Section 59's are amazingg how can you not make love wee over them........ they're staying..." and that'll be that.

Wheelspinning out of junctions demonstrates either a deliberate or accidental lack of control. Either of those can be easily interpreted as driving without due care, as for the music thing; freedom of expression is all well and good but does EVERY c**t in a 300m radius NEED to hear what you're listening to. I think not.
It's not about people needing nannying either, If someone were to sit outside my house with their stereo going full blast in the middle of the night I'd have no compunction about demonstrating my displeasure with the aid of a five pound lump hammer and automatic centre punch or failing that, builders foam. I most certainly don't need legislation to help me in that task but, having the legislation in place means it's less likely I'll have to.

ST's are far too nice and Mk2 Golf's are far too rare and under rated for some numb nut in a car he'll probably never be able to drive properly to start knocking about!

I agree with whats being said, my local site organised a meet on Sunday 17th, and they advetised it on Facebook... therefore a bunch of chive's arrived wheelspinning etc, doing burnouts in a Metro... we all decided to leave and convoy to a different location and leave them too it, as we left CID had blocked the entrance and were talking to us one by one, they came to me and asked me if I had been doing burn outs, I said no, he then said he could hear my exhaust rumbling and asked me to rev it, which I did, and he replied with Ahhhh so its you thats upsetting the public with your noise then, to which I replied rather angrily, No officer, I've just switched my car on to leave the car park as a bunch of chive's are causing trouble, I'm a car enthausiast not a chive, If you want to find the source of the complaint you have recieved then go into the car park now and see whats happening!...Which he did, and I went on my merry way!
There is always a bunch of idiots that spoilt it for the masses, they are the reason real car enthausiasts get a bad name!
But I do agree that Police can be tossers sometimes! A couple of months ago there was a massive meet in Milton Keynes which a bunch of people, including myself went down to. Nobody was doing anything wrong at the meet but the police felt it appropiate to wait at the exit and as we all left they fined each and everyone of us for the most ridiculous things, if anything at all!
I think there should be guidlines for section 59, for it to be used at the appropriate times etc.

Agreed Luke. To abolish it would be the same as saying "Chives do what you want" but at the same time, the Police should be a bit sensible with how they hand them out and stop generalising everyone with a modified car as a chive out to cause trouble.
I'm gonna do some bits to my Fiesta, but I won't be some chive.

I have a Magnex performance exhaust system that cost £400... a chive has a big jap can back box that cost him a tenner from one of his homies... the Police should take a crash course in realising the difference I think lol.
